Customer information, cancellation policy for Consumer Orders and General Terms and Conditions of Siebert Luftfahrtbedarf GmbH:

(1) The following terms and conditions apply exclusively to orders placed by telephone, in writing, by fax or e-mail, and to orders placed online via our web store or shopping portals. The following terms and conditions do not apply to cash sales and personal orders. Any terms and conditions of the buyer that deviate from our terms and conditions shall not be deemed to have been agreed unless we have given our express consent in writing.

(3) The contract of sale shall be concluded upon receipt of your order and dispatch of an order confirmation or dispatch of the ordered goods. An automated confirmation of receipt by e-mail for orders via our webshop is not considered a binding order confirmation.

(4) Right of withdrawal
Consumers have a statutory right of withdrawal. A consumer is any natural person who enters into a legal transaction for a purpose that can be attributed neither to his commercial nor to his independent professional activity (§ 13 BGB).

Cancellation policy

Right of revocation
You can revoke your contractual declaration within 14 days without giving reasons. The revocation period is 14 days from the day on which you or a third party named by you, who is not the carrier, has or has taken possession of the goods.

In the case of a contract for several goods ordered as part of a single order and delivered separately, the period begins on the day on which you or a third party named by you, who is not the carrier, have taken or has taken possession of the last goods.
In the case of a contract for the regular delivery of goods over a fixed period of time, the period begins on the day on which you or a third party named by you, who is not the carrier, have taken or has taken possession of the first goods.

To exercise your right of revocation, you must inform us by means of a clear declaration (e.g. a letter sent by post, fax or e-mail) of your decision to revoke the contractual declaration. The revocation is to be addressed to:

You can use the model withdrawal form for your withdrawal, but it is not mandatory. To meet the cancellation deadline, it is sufficient that you send the notification of the exercise of the right of cancellation before the expiry of the cancellation period.

Consequences of revocation
In the event of revocation, we will repay you all payments that we have received from you, including delivery costs (with the exception of additional costs resulting from the fact that you have chosen a type of delivery other than the favorable standard delivery offered by us) immediately and at the latest within 14 days from the day on which we received the notification of revocation of the contract. For this repayment, we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you; in no case will you be charged for this repayment. We may refuse repayment until we have received the goods back or until you have provided proof that you have returned the goods, whichever is the earlier. You must return or hand over the goods to us immediately and in any case no later than 14 days from the day on which you notify us of the revocation. The deadline is met if you send the goods before the expiry of the period of 14 days. You shall bear the direct costs of returning the goods.

You will only have to pay for any loss in value of the goods if this loss in value is due to handling of the goods that is not necessary for checking the condition, properties and functioning of the goods.

Unless otherwise specified, the right of revocation does not apply to distance selling contracts

  1. for the delivery of goods that are made to customer specifications or clearly tailored to personal needs or can spoil quickly or whose expiration date would be exceeded (e.g. spare parts, Veryon online services, parachutes as well as database updates for GPS, AIPs, Jeppesen manuals and trip kits, aviation charts, calendars).
  2. for the delivery of newspapers, magazines or periodicals with the exception of subscription contracts.
  3. marked special items for commercial use, see also (10).
The right of withdrawal for the delivery of audio and video recordings or software shall expire if the delivered data carriers have been unsealed by the consumer. In the case of the delivery of digital content that is not stored on a physical data carrier (e.g. CD, DVD, etc.), you expressly agree to the execution of the contract before the expiry of the withdrawal period and the expiry of the right of withdrawal with the start of the execution of the contract. In the case of the delivery of such digital content, you thereby waive your right of withdrawal.

(5) Electronic commerce
In the case of contracts in electronic commerce (e.g. webshop), you have the option either as a guest or as a registered customer to add products to the shopping cart, then select the desired shipping and payment method, before you confirm that you have read our terms and conditions and the cancellation policy.
Before sending your order, you have the opportunity to check your personal data and the order data again and correct them if necessary.
After sending your order, you will immediately receive a confirmation of receipt.
The contract is then concluded either by sending and receiving an order confirmation or sending the ordered goods. The text of the order confirmation will be saved.
The contract is concluded in German. You can print out the contractual provisions and these General Terms and Conditions or save them as a download.

(6) If you order an AIP VFR Online, the service will be renewed after 12 months for a further 12 months at the current publisher's price, unless you cancel at least eight weeks before the expiration date. Invoices for the extension of the online service are payable within 14 days. In the event of late payment, we are entitled to cancel the contract immediately without a reminder.

(7) All price quotations are total prices including German value added tax at the current rate of 7% for books and aviation charts and manuals or 19% for other items. For deliveries to commercial customers in EU countries outside the Federal Republic of Germany, German VAT will not be charged if a valid VAT identification number is provided to us when the order is placed. For all other deliveries to EU countries, the sales tax of the destination country will be charged. This may result in different prices. For shipments to non-EU countries, the prices will be reduced by the VAT contained therein. When shipping to non-EU countries, additional import duties may be levied on import. Information on this can be obtained from the customs authority of the destination country.

(8) All prices are unpacked ex Münster (Westf). Shipping costs are calculated most favorably according to value, weight, volume and nature of the goods. Insofar as we indicate flat rates for shipping costs, these shall only apply to a related delivery and order according to (1). The transport is at the expense and risk of the recipient. At the express request of the purchaser, transport insurance will be taken out. The costs incurred for this shall be borne by the buyer.

(9) Our deliveries are payable immediately by advance payment, Paypal or debit by credit card. For known customers in Germany, delivery by invoice can also be agreed upon upon request. In this case, the invoice amount is payable immediately upon receipt of the delivery without deduction. Deliveries abroad will be made exclusively by advance payment, PayPal or credit card payment. If you pay in advance, please transfer the amount to our account IBAN DE78 4401 0046 00522 46460 at Postbank Dortmund, BIC SWIFT PBNKDEFF. Advance payments from abroad must be made by SEPA transfer, free of charge for the recipient, exclusively to our aforementioned account at the Postbank Dortmund. For other payments from abroad, we must charge an additional € 13.00 for German bank charges.

(10) The following articles are marked with (G) as special articles for commercial use:

  • Items sold in quantities that differ from the price quoted per unit of quantity (e.g. aircraft plywood in sheets of approx. 1.69 - 2.4 m²)
  • Articles which, due to their weight and volume (e.g. rolled covering materials, winch tow ropes) or the nature of their goods (hazardous goods, e.g. paints, resin components), cannot be shipped at the flat rate shipping costs.
Since for these articles, due to delivery quantities or shipping costs that cannot be calculated exactly in advance, it is not possible to give an exact price including shipping costs in accordance with the legal regulation pursuant to Article 240 of the Introductory Act to the German Civil Code, such special articles shall be delivered exclusively to commercial customers. The purchaser of special articles declares with the order that he will use these articles commercially. For these articles there is no right of return or revocation according to (4). The delivery of such articles is carried out freight forward or the shipping costs are calculated according to actual expenditure. Please note the minimum shipping costs of € 89.00 for dangerous goods shipments within Germany.

(11) Complaints due to incomplete or incorrect delivery must be reported immediately, at the latest, however, within 14 days after receipt of the goods. Damaged shipments must be claimed immediately from the carrier (Post, UPS, DHL, forwarding agent). Claims for damages due to a damaged shipment must be made immediately directly to the carrier.

(12) If goods are not available although we have made a congruent covering transaction and have been let down by our supplier, we shall be entitled to withdraw from the contract. In this case, we will inform you immediately about the non-availability and reimburse already rendered services without delay.

(13) When ordering articles which are not yet available at the time of the order (e.g. new editions of aeronautical charts, calendars,) we will charge the shipping costs for the subsequent delivery at the lowest possible price. 

(14) Legal warranty rights exist for all goods.

(15) Our liability is limited to intent and gross negligence. This limitation of liability shall not apply to damages resulting from injury to life, body or health. The limitation of liability shall also not apply to the breach of material contractual obligations (so-called cardinal obligations). In the event of a breach of an essential contractual obligation (e.g. provision of ownership of the goods), liability shall, however, be limited to the foreseeable damage typical for the contract.

(16) The delivered goods shall remain our property until payment has been made in full or, in the case of payment by check, until the check has been cashed.

(17) Place of performance for delivery and payment is Münster (Westf).

(18) Your data will be stored electronically for order processing. By placing an order you agree to the storage of your data. We only make order data accessible to third parties if it is unavoidable for the fulfillment of your order, e.g. for the dispatch of rectification services. We use your address for sending information material by us. If you do not wish to receive further catalogs, you can inform us at any time by sending a message to Siebert Luftfahrtbedarf GmbH, Rektoratsweg 40, 48159 Münster.

(19) The place of jurisdiction is Münster (Westf) for merchants, also in the case of dunning proceedings. For all other customers, the statutory provisions shall apply with regard to the place of jurisdiction. The contractual relationship shall be governed exclusively by the law of the Federal Republic of Germany to the exclusion of the UN Convention on Contracts for the International Sale of Goods.
